Conditions for a residence permit other than the Temporary Protection Directive

If you have fled from Ukraine you usually stay in the Netherlands under the Temporary Protection Directive (TPD) or get an asylum residence permit. In some cases you can get another residence permit. This is called a regular permit. Read how this works here.

There are three types of regular residence permits

These are the three types of permits.

  • Study permit: You can get this if you are studying in the Netherlands

  • Work permit: You can get this if you have a job in the Netherlands

  • Partner permit: You can get this if you have a partner or spouse who lives in the Netherlands or is a Dutch citizen.

A regular residence permit is different from the temporary protection or asylum permit

You must meet several conditions to get one of the three regular residence permits. It also costs money to apply for a regular residence permit. The

Immigration and Naturalisation Service (IND)
can revoke your regular permit if you no longer meet the conditions, for example, because you have stopped studying, no longer have a job or you are no longer in a relationship with your partner. The IND cannot do this in the
Temporary Protection Directive (TPD)
or for your asylum residence permit, different conditions apply to these schemes.

These are the conditions for a study permit

Do you want to study in the Netherlands and get a residence permit based on that? Then you need a study permit. There are several conditions to get a study permit. For example, you must show that you are enrolled at a Dutch college or university. You must also have sufficient income. The school will do the application with the IND for you. This costs € 228. For information about these conditions, you can contact the college or university where you want to study. They will help you apply for a study permit.

Are you not in the Netherlands yet? In order to travel to the Netherlands because of your permit, you must apply for and pick up a

'Machtiging tot Voorlopig Verblijf' (authorisation of provisional residence)
at the Dutch embassy in Ukraine.

These are the conditions for a work permit

There are strict conditions if you want to apply for a work permit. For example, it must be clear that there is no one in the European Union who can also do your work. The employer makes the application for your work permit to the IND. An employer only does this if you are a specialist in your work. Without education and diplomas, you usually have no chance of getting a work permit either.

Do you fall under temporary protection and have a job in the Netherlands? Then you usually cannot get a work permit.

Are you not in the Netherlands yet? In order to travel to the Netherlands because of your permit, you must apply for and pick up an MVV at the Dutch embassy in Ukraine.

These are the conditions for a permit based on your partner in the Netherlands

Do you have a partner or spouse in the Netherlands? Then you can sometimes get a regular residence permit. Your spouse or partner must live in the Netherlands, have Dutch nationality or have a permanent residence permit in the Netherlands. The application costs €228. Your relationship must meet these conditions:

  • You are in a serious relationship or you are married.

  • Both of you are 21 years of age or older.

  • You will live with your spouse/partner.

  • Your spouse/partner has enough income.

You can find the exact amount of income on the IND website.

You or your partner apply for this permit at the Dutch embassy in Ukraine. You can also apply for it at the IND if you are already in the Netherlands and have temporary protection, and meet all the conditions for the regular residence permit.

Your rights do not change if you first had temporary protection and now a regular permit

Sometimes you get temporary protection in the Netherlands first, and later you do get a permit for work or study. Your rights then do not change. This means that these people are still entitled to a place in a reception centre and healthcare through the RMO. You are no longer entitled to living and food allowances. Not all municipalities know this, but you are entitled to them.
