Asylum procedure now takes longer if you have fled Yemen

Have you fled from Yemen? Then from now on you will receive the same asylum procedure as other nationalities. Previously, the Immigration and Naturalisation Service (IND) handled the asylum applications of people from Yemen faster and in a different way. Read here how the IND now assesses your asylum application if you come from Yemen.

You can still get asylum in the Netherlands, but you have to explain more about your personal situation

The

Immigration and Naturalisation Service (IND)
deems the situation in Yemen to be still unsafe for certain groups of people, and there is still a chance that you will be granted asylum in the Netherlands if you come from Yemen. Yet the IND is going to assess your asylum application differently. These 2 things are going to change:

  • The IND used to decide on your asylum application faster if you fled from Yemen. From now on, they will assess your asylum application as quickly as those of all other nationalities.

  • The IND first thought that the violence in Yemen was so bad that everyone from Yemen was automatically entitled to asylum in the Netherlands. Therefore, you did not have to explain your personal situation. The IND still thinks that people from Yemen can be in danger, but not that everyone is equally at risk. Therefore, from now on, you have to explain more about your personal situation in Yemen during your interviews with the IND.

The IND will pay attention to these things when people from Yemen apply for asylum

The IND is still going to pay attention to the situation of war in Yemen when assessing your asylum application. They are also going to pay attention to personal reasons why you might be in extra danger. For example, maybe you are in more danger because you:

  • Have a physical disability

  • Had an occupation in Yemen that put you at greater risk

  • Are very young or just very old

  • Belong to a high-risk group. For example, because you were a journalist, activist or opponent of the government in Yemen. Or because you belonged to an ethnic, religious or other minority, for example because you are

    LGBTQIA+
    .

If you already have a Dutch asylum permit, it remains valid

Have you fled Yemen and already have an asylum residence permit in the Netherlands? If so, you will keep this permit and the IND will not reassess your asylum application.

You can still apply for family reunification

Do you have an asylum residence permit and want to reunite with your family members from Yemen? Then you can still apply for family reunification. Applications that are already being processed by the IND also continue.
