Netherlands allowed to stop reception for people without Ukrainian nationality

The European court decided that the Netherlands could stop the reception of people earlier who had temporary residence permits in Ukraine. Dutch courts must now decide exactly what this ruling means. Until then, you may remain in the Netherlands.

The highest Dutch court decided that the temporary protection could stop earlier

On 17 January 2024, the highest Dutch court (

Council of State [Raad van State, RvS]
) ruled that temporary protection would end after 4 March 2024. This ruling applied to anyone who had a temporary residence permit in Ukraine, such as for work or study. The Dutch government also felt that these people could also return to their country of origin.

European court vindicated Dutch court

Some courts in the Netherlands disagreed with this ruling. On the contrary, in individual court cases, these courts said the refugees were allowed to stay in the Netherlands. The Council of State asked the European courts how to understand the rules of temporary protection because there were different rulings.

The European court has now ruled that the Netherlands was allowed to stop the temporary protection. This means that now all Dutch courts can resume ruling on individual lawsuits of people with temporary residence permits in the Netherlands. These court cases had been paused until the European court had ruled.

You are entitled to temporary protection until a decision is made

It is now up to Dutch courts to determine what this European ruling means. It is not yet clear when Dutch courts will make a decision. Until then, you can stay in the Netherlands. That means you are entitled to:

  • A place in a reception centre 

  • Care 

  • Living allowance 

  • Work 

  • Education
