What you need to know if you are staying in the Netherlands without Ukrainian citizenship

Have you fled Ukraine and had a temporary residence permit there? Then the temporary protection in the Netherlands stopped for you in March 2024. Due to a ruling by the Dutch court, you are still entitled to temporary protection. Read here what this ruling means for you.

You are entitled to temporary protection in the Netherlands

On 17 January 2024, the highest Dutch court, the

Council of State (RvS)
, ruled that the temporary protection for refugees from Ukraine will end after 4 March 2024. This ruling applied to anyone who had a temporary residence permit in Ukraine, for example for work or study.

As some courts disagreed with this ruling, the Council of State asked the European court for a ruling. It is not yet clear when the European court will issue a ruling. Everyone is allowed to wait in the Netherlands for the ruling of the European court. This means that you are now entitled to again:

  • A place in a reception centre

  • Healthcare

  • Living allowance

  • Work

  • Education

It is not yet clear when the highest European court will issue a ruling. If the European court says earlier than 4 March 2025 that the

Immigration and Naturalisation Service (IND)
may stop temporary protection, then temporary protection for you will stop immediately.

European court ruling

On 3 September 2024, the European court heard the case. On 22 October 2024, the Advocate-General will issue an opinion. The Advocate-General is a European court that will conduct its own investigation. It provides advice to the European courts hearing the case. The courts do not have to do anything with the opinion of the Advocate-General. The European court will then issue a ruling. It is not yet clear when that will be.

After that, the RvS will issue a ruling. The RvS is obliged to follow the ruling of the European court.
